A friend, resident in England, is selling his house here in France. As he doesn't want the expense of coming across he has asked me if I could act as proxy for him and sign the sale documents.
Can anyone tell me if this is legal and if so are there any pit-falls?
They could also instruct the Notaire's assistant to sign on their behalf if they wish, indeed I have done just this when purchasing a property and had no wish to travel to Paris just to sign the acte. There are several forms to fill in beforehand though.
The only pitfall is if they become unhappy with their purchase later, and blame you. You may lose a friend.
As Chris W has said, it is certainly more normal for a person to appoint one of the Notaire's clerk to act as power of attorney. Your friend will have to request the form from the Notaire and have their signature witnessed in front of a UK solicitor (as far as the local Notaire we use is concerned).
You know what I do for a profession and I too am with the others on this posting. Keep well away and let one of the assistants at the Notaires do it. Is it the Notaires at Tessy or Villedieu. Whatever they are well used to doing this sort of thing.
with the others on this, it could be a disaster. I signed for a notaire's secretary to sign the acte de vente but no-one told me about the guarantie decenale and it's in none of the paperwork i signed however it is in the acte de vente so earlier this year i got stung for 1000€. The only concelation was that it wasn't a friend.
